Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Scrapeer website, application, and services (collectively, the "Service") operated by Intuitive Systems Novesia UG (haftungsbeschränkt) ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

You may sign up using an email and password, or via a third-party OAuth provider (e.g., Google, GitHub).

3. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms. We maintain limited abuse logs for up to 60 days to comply with legal obligations and to investigate complaints.

4. Your Automations and Data

You retain ownership of all automation flows you create and data you collect using the Service ("Your Content"). By using the Service, you grant us a limited license to host, store, and process Your Content solely to provide the Service to you.

You are solely responsible for ensuring that your automations and the data you collect comply with all applicable laws and third-party terms of service. We do not monitor or review the content of your automations or extracted data.

4.1 Secret Variables

The Service allows you to store secret variables (API keys, passwords, tokens) for use in your automations. Secret values are encrypted and stored separately from application data — never in plaintext. You are responsible for the security of any secrets you store.

4.2 Uploaded Files

Files you upload are stored in EU-based cloud storage. You may delete uploaded files at any time. Files are permanently deleted when you delete the associated project or your account.

5. AI Copilot

Copilot is an AI-powered feature that helps you build automation flows by interpreting natural-language instructions. When you use Copilot, your prompts and flow metadata are sent to third-party AI providers for processing. Secret values and file contents are never sent. Copilot requires explicit consent before first use.

6. Stealth Mode

Stealth Mode is an optional feature that routes outbound automation traffic through a third-party proxy provider to reduce the chance of being blocked. No Scrapeer user personal data is shared with the proxy provider.

You are responsible for ensuring that your use of Stealth Mode complies with the terms of the websites you automate and with applicable law.

7. Subscriptions and Payments

7.1 Free Tier

We offer a free tier with limited features (including a limited daily Copilot trial). The free tier may be modified or discontinued at any time with reasonable notice.

7.2 Paid Plans

Paid subscriptions are billed in advance on a monthly basis. Prices are displayed in Euros (EUR) and are exclusive of applicable taxes unless otherwise stated. Subscription usage is tracked via a credit system.

7.3 Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No pro-rata refunds are provided for unused time within a billing period. 7.4 Price Changes

We may change subscription prices with at least 30 days' advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

8. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by Intuitive Systems Novesia UG (haftungsbeschränkt) and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features.

9. Third-Party Services and Target Websites

The Service integrates with third-party services including AI providers, cloud infrastructure, and proxy networks. We are not responsible for the availability, content, or practices of any third-party services. Your use of features that involve third-party services (Copilot, Stealth Mode, OAuth login) is subject to the respective providers' terms.

9.1 Target Websites and Automated Services

Intuitive Systems Novesia UG (haftungsbeschränkt) has no affiliation, partnership, or contractual relationship with any third-party websites, platforms, or online services that you access or automate using the Service ("Target Websites"). Any mention of third-party services within the Service is provided for informational purposes only.

You are solely responsible for verifying your rights and authorizations to access and automate any Target Website, including compliance with the Target Website's terms of service, robots.txt directives, and any applicable laws. We accept no liability for your use of the Service in connection with any Target Website.

You acknowledge that Target Websites may take measures against automated access, including but not limited to rate limiting, IP blocking, account restrictions, or legal action. Such consequences are your sole responsibility and risk. We are under no obligation to intervene on your behalf with any Target Website operator.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the extent permitted by applicable law. We do not warrant that the Service will be uninterrupted, error-free, or secure.

The Service is a technical tool. The availability of any feature — including Stealth Mode, proxy routing, or any other functionality — does not constitute a representation, warranty, or legal advice that any particular use of the Service is legal or permissible. We do not represent or warrant that all possible uses of the Service are legal or lawful. You are solely responsible for determining the legality of your specific use case.

We do not guarantee the accuracy, availability, or continued functionality of any third-party websites you automate using the Service. Website structures change frequently, and automations may require maintenance.

11. Limitation of Liability

11.1 Unlimited Liability

Nothing in these Terms limits or excludes our liability for: (a) intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit); (b) injury to life, body, or health; (c) claims under the German Product Liability Act (Produkthaftungsgesetz); or (d) any other liability that cannot be excluded or limited under mandatory applicable law.

11.2 Cardinal Obligations

In cases of slight negligence, we shall only be liable for breaches of material contractual obligations whose fulfillment is essential to the proper performance of this contract and on whose compliance you may regularly rely ("Cardinal Obligations"). In such cases, our liability is limited to the foreseeable damages typical for this type of contract at the time of its conclusion. Our total aggregate liability for such claims shall not exceed the fees you paid us during the 12 months preceding the event giving rise to the claim.

11.3 Exclusion of Further Liability

Subject to Sections 11.1 and 11.2, we shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising from or related to your use of the Service. In particular, we shall not be liable for any damages, losses, or consequences arising from actions taken by Target Websites or their operators in response to your use of the Service.

11.4 Scope

The limitations of liability set out in this Section 11 also apply in favor of our legal representatives, employees, and agents.

12. Indemnification

You agree to indemnify, defend, and hold harmless Intuitive Systems Novesia UG (haftungsbeschränkt) and its managing directors, employees, and agents from any and all third-party claims, damages, losses, or expenses (including reasonable legal defense costs) arising from or related to:

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page, updating the "Last updated" date, and — for significant changes — sending a notification to your registered email address. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
